Terms & Conditions – Air Ambulance 24 GmbH
The following terms and conditions are part of the agreement. Deviating agreements are only valid if they have been confirmed by Air Ambulance 24 GmbH in writing.
1. REGISTRATION / CONCLUSION OF CONTRACT
The contract comes into existence only when the customer accepts the offer of the Air Ambulance 24 GmbH in writing or by email. Until the written acceptance of the offer by the customer takes place, the offered or mediated transport service remains non-binding and subject to the availability of the flight. Thereafter it is subject to technical and meteorological feasibility, the granting of all traffic rights, slots as well as other regulatory approvals.
2. CONDITIONS OF CARRIAGE
The services of Air Ambulance 24 GmbH take place according to the offers of the air ambulance service Augsburg. Unforeseen additional costs such as war risk insurance, royalties, late opening fees, arrangement costs, etc. are invoiced separately. Changes to the flight route, flight data and flight times can be invoiced in accordance with the additional expenses and incidental charges.
3. LIMITATION OF LIABILITY
The transport of passengers, baggage or cargo is subject to the Warsaw Convention. The ambulance service is not liable in situations of force majeure, in particular meteorological conditions, strikes, wars or sabotage.
4. FLIGHT TIMES
The flight times shown in the offers / order confirmations are actual flying hours, excluding the time of check in/out and meteorological conditions.
5. DOCUMENTATION FROM THE PASSENGER
The passenger is obliged to produce all the necessary entry and exit documents and other documents prescribed by the relevant countries.The Air Ambulance 24 GmbH has the right to refuse the transport of passengers or cargo that do not comply with the relevant provisions and rules, whose documents and entry and exit documents are incomplete. The Air Ambulance 24 GmbH is not liable for the damage caused.
6. CANCELATION FEES
In case of cancellation of a flight or a stage of the journey by the customer or due to the inability to transport the patient, the following cancellation fees apply:
- from reservation to 96 hours before the scheduled departure 5% of the charter price, but at least € 1,500.00for the King Air and Learjet, € 3,000.00 for the Challenger
- between 96 to 48 hours before scheduled departure 20% of the charter price, but at least€ 2,500.00for the King Air and Learjet, € 6,000.00 for the Challenger
- less than 48 hours to 24 hours before scheduled departure 40% of the charter price, but at least€ 2,750.00for the King Air and Learjet, € 10,000.00 for the Challenger.
- less than 24 hours before scheduled departure 60% of the charter price, but at least € 3,000.00for the King Air and Learjet,€ 15,000.00for the Challenger.
If additional costs for catering, airport charges, overflight clearances, providing or positioning, etc. are incurred, these will be additionally charged.
7. CONDITION OF THE PATIENT
If the health of the patient deteriorates before or during the flight, or it is determined that the patient cannot be transported, the Air Ambulance 24 GmbH reserves the right to administer medical treatment at the patient’s location or to fly to the nearest suitable airport. If the patient requires medical treatment prior to departure or at the place of emergency landing, the Air Ambulance 24 GmbH is not liable for the resulting costs.The treatment of patients is carried out at their own cost.
8. BROKERS / BROKER CONTRACTS
If the Air Ambulance 24 GmbH operates for third parties on behalf of an intermediary / broker, the intermediary / broker shall, along with the client, bear liability towards the air ambulance service.
9. PAYMENT
Unless otherwise agreed, payments are due at least 2 working days prior to departure. If payment is not on time, the Air Ambulance 24 GmbH is entitled to withdraw from the contract and claim damages. The default interest rate is 8 percentage points above the base rate of the European Central Bank. € 15 will be charged for each reminder. Settling with other claims is excluded, unless there is an undisputed or legally established claim.
10. WRITTEN FORM CLAUSE
Any amendment to this contract must be in writing. The same applies to any change in the requirement for the written form.
11. SALVATORIC CLAUSE
If any provision of this contract is invalid or unenforceable or becomes invalid after its conclusion, the validity of the remaining provisions shall remain unaffected. The ineffective or unenforceable stipulation is to be replaced by an effective and enforceable regulation which reflects most closely the economic intention followed by the parties to the agreement by the ineffective or unenforceable stipulation. The foregoing provisions shall apply correspondingly in the event that the contract proves to be incomplete.
12. JURISDICTION
Jurisdiction is Augsburg, Germany.
